Legal Question in Personal Injury in
Statute of limitations
My wife had her knee cap broken while being thrown into a swimming pool. Many operations later her knee is giving her major problems. This happened 15 years ago. What can be done?

Re: Statute of limitations
This is a personal injury, and PI has a 6 year statute of limitations (SOL). Unless the person was unable to institute suit earlier (they were incompetent - ie- in a coma, under the influence of disease of the mind (legally insane, etc.) then the 6 years has past. The other exception is discovery - ie- you didn't know of the injury until some time after the act causing the injury occured. Say a doctor did a surgery which made it difficult or impossible to concieve a child, but you didn't 'discover' the impact of the act until years later...then the SOL would run from the time of discovery. Sorry.
