Legal Question in Real Estate Law in India
we have 4 brothers. Father expired in 2008 and mother expired in 2013 without will. We have a 2.5 story building and want to divide in 4 brothers after construction of 4 floors with parking. I want to know what is the procedure, how we choose floor ( may be lottery method ), how we decide the price difference between floors.( as the cost of ground floor is higher then first floor) What are the other common terms & condition to live peacefully.

There is no prescribed law for the mode of division. All of you have to be agreed on a certain adjustment and negotiation and if it is finalised, you can get a family partition deed registered. If that does not happen, a suit has to be filed which may take years.
