Legal Question in Real Estate Law in India
Mr. A is th owner of flat . He is having 3 sons .Mr. X na eldest brother has managed to transfer the said flat in his wife's name by misrepresenting his father ie by making a payment from wife's bank account to the fathers account and then managed to withdraw the same amount from fathers account. Thus, actually father didi not get any money for the said transfer Even stamp duty has been paid on the said sale transaction from father to eldest son's wife.
Now father realises his mistake after span of 5 years as after his death eldest brother's wife will chuck out other 2 brothers and their family and claim the ownership rights as even society maintenance bills also come in her name.
father's condition is deteriorated day by day as he is very worried to see the fate of their two sons after his death .
what option left for the father and other two sons to safeguard their share of property
Please advise.
