Legal Question in Real Estate Law in India

Myself Mr.birendra kumar. I had booked a flat in kolkata with a Infrastructure company.. They promissed me to do the sale agreement with in 9 month but could not keep the promise. As per the Provisional Allotment letter they are ready to refund the booking amount with 18 % interest but asking the original Receipt of the amount and than they are telling they will process the claim and will take 90 days for refund. But i scare if after taking the receipt original they refuse to accept that i had booked a flat with them. Please suggest on this case. I will be greatful for the suggestion.

For processing of claim even a photocopy would be sufficient. Send a legal notice to refund with interest and if that does not materialize, file the complaint in consumer forum. For more help you may call me.

Dear Birendra,

English : Handover the Original Receipt in exchange for the Demand Draft / Pay Order on the receipt amount plus interest @ 18% per annum for the total period.

Hindi : Ek haath say original receipt dena, aur doosray haath say diye gaye paisay adhaar takka byaaj saheet Demand Draft / Pay Order dwara lena.

Marathi : Eka haataanay paavti devoon dusryaa haataanay athraa takkay vyaaz saheet samorchya kadoon ekun rakkamacha Demand Draft / Pay Order ghyaava.
