Legal Question in Wills and Trusts in Mexico
My grandparents past away about 15 years ago and left an apartment complex. My uncles and aunts took over the complex and started to collect the rent from the complex and divided into equal parts every month. So everyone received their share of the rent money. This property is located in Tijuana, Mexico. Here is where I need clarifying, within the past 7 years one of my uncles, 2 of my aunts and mom have passed away. Since they have passed away my living aunts and uncles have been keeping my deceased uncles and aunts share of the rent money. I have always felt that it wasn't fair that they kept the their share and not give it to their family. My grandparents didn't leave a will or a trust. So my question is do my cousins have legal right to that share of the rent money? Should have they continued to include them the sharing? Because now my living aunts and uncles want to file for the trust and they need the eldest grandson or granddaughter from each deceased family. I hope this makes sense....I just want to know if my cousins and I are entitled to the rent money as well?

I see this question was posted since September last year, so I hope I can still help you: When a person dies and leaves NO Will or trust then the order to inherit is SPOUSE, if no spouse then the sons (in this case your mon, uncles and aunts). Now the rights that your mom inherited now are yours and of your brother, sister or father. You have legal right to the rents that have being perceived since your mother past away. you don�t have any right on what your aunts and uncles that past away left unless they didn�t have any children (cousins of yours).
