The first thing you should do is to review your agreement with the credit card company. If you are lucky there will be an arbitration provision for disputes arising under the agreement. Then you can proceed accordingly. Or, if there is no provision for resolving disputes in your agreeement, you could bring an action, if the amount is less than $5,000 in small claims court. Otherwise in the Superior Court, either Limited Jurisdiction or Unlimited Jurisdiction. Limited is below $25,000 and unlimited is over $25,000, for the money they were supposed to have paid to your family, or, by now, maybe all you really want is credit against you account. A judgment for the amount will accomplish both.

You should first document your situation by writing a letter to the legal department of the credit card company via certified mail (keep a copy). Documentation is the most important thing. You may also want to request arbitration at that point. Go straight to the legal department. If that doesn't work, you will probably want to file a small claims case in the district court of the local county in Alabama.
