Re: Appeal for a Individual who has been wrongly imprisoned

If the person who was convicted accepted a plea bargain and entered a plea of guilty, then he waived his right to appeal the case unless he reserved specific issues at the time he entered his plea. If he feels that he received ineffective assistance of counsel or thinks there is some other basis for setting aside his guilty plea, then he may be able to file a petition with the court asking for a new trial. However, he will need to act quickly if he wants to pursue any issues of that nature. If you would like to discuss the matter with my office, please feel free to give us a call.

You could re-post for Ala. attorneys, not CA attorneys. However, a plea bargain accepted is a conviction agreed to without appeal, barring extraordinary legal circumstances. You now live with the consequences of your actions and decisions. It's a 'contract' that is enforceable. You gave your word to the court that you accepted the deal in return for avoiding trial and sentencing to the full extent of the law. If you didn't like the deal, you shouldn't have taken it, and gone to trial if you thought you had defenses. You don't get 'buyers remorse' 'do-overs' in real life or the legal system.
