Legal Question in Criminal Law in Alabama
Misdemeanor Removal
In 1998 I was arrested for Domestic Violence but was never convicted. The Judge told me that I had to attend 9 sessions of anger management and he would dismiss the case. I did. It was dismissed, but it still shows up on my record that it happened. I want to have it removed if I was never convicted of it. I am still married to the same woman after 10 years and we have a wonderful marriage. I am trying to become a city Firefighter and Im afraid that this ''Dismissal'' will be interpreted wrong or not get me hired. Can I get it removed off my record and How?
I do have a DUI in 2000. Will that have any affect whether a judge will remove that ''dismissal''? Thanks for your time.

An arrest record remains there for ever, and there is no way to remove the arrest from your record. The only way to get it removed would be to get the law changed.
Re: Misdemeanor Removal
Nice try, but no brass ring. Domestic Violence convictions can not be expunged, and the same logic would apply to any attempt to get the record of dismissal sealed. Even if it was expunged or sealed, it MUST be disclosed in any application to government agencies for licensing or employment in first responder jobs.
