Legal Question in Family Law in Alabama

when can an attorney withdraw from a case?

Our attorney is trying to withdraw from our case. Our last court date was continued, so we didn't even see the judge and now our attorney sent us a letter saying that he feels it is in our best intrest if he withdraws.

Re: when can an attorney withdraw from a case?

Typically an attorney can withdraw for most any reason so long as it doesn't harm his client. Now, he most likely couldn't do it the day before a trial, or something like that, but if it won't prejudice your rights, it is pretty liberal.

Here is what to do. Get any retainer back owed to you for work not done, get your file from him, and find another attorney.

I am in Birmingham, so it would probably be difficult for me to do it, so call some more in the Decatur area. I am sure someone will do it.

Good Luck!
