Legal Question in Family Law in Alabama
Conception after divorce
Me and my ex-wife conceived a child after our divorce. Therefore neither of us have custody. I pay child support that is not court appointed, yet I do not get to see my son unless she o.ks the visit then it is on her terms. I have done a search on custody but all that I can find is divorce related. What are my rights when I go to court and how will child support be determined?

Custody and visitation are determined by what the court feels is in the "best interest" of the child. There are too many factors involved to advise you here. Furthermore, a lawyer would need to know a lot more about you and the mother in order to predict what would happen in court. As far as child support is concerned, that is determined according to a rather involved formula called the South Carolina Child Support Guidelines. It takes many things into consideration such as each parents income, debts, assets, etc. It also takes into consideration any special needs of the child. Due to the complex issues involved in your situation, I recommend that you contact a family law attorney in your area and sit down and discuss you situation. Good luck.
