Can a biological father petition the court for DNA testing. If the mother got married to another man when the child was born and the his name was put on birth certificate in the state of Alabama. She is denying his rights as a father because she is mad at him.

If the child was married at the time the child was born, then there is a legal presumption that the husband is the father and that can be used to defeat the paternity action.
