Who is responsible for burial expenses?

My brother died. His wife refused to pay for the burial expenses, but attended the funeral. She is threatening to sue for the clothes we removed from his home.(she had left him and was in Georgia with a boyfriend)Can we sue her for the funeral expenses. He died as a result of oxycontin abuse, given to him by this woman, who purchased it herself from a dealer.
