Legal Question in Family Law in Alabama

Step-Parent obligation for child support

My husband divorced his ex about 4 years ago and at the time they were both working. Now my Husband makes considerably less than he did at the time and his ex-wife has voluntarily quit working to stay home with her new baby. We have never been late or short on her payments, however, she has expressed that she may take us back to court. My question is can my salary be used to calculate the child support payments and with her no longer working how could that affect what we pay?

Re: Step-Parent obligation for child support

Your salary would not be a factor. If she is not working due to another child, it depends on how long she intends not to work, whether she is able to work, etc. If your husband is making a lot less, he might wish to consider filing for a reduction himself. You need to consult with an attorney in your area.
