Legal Question in Insurance Law in Alabama
Automobile Accident
About four months ago, I was involved in a three vehicle accident. I am not the party at fault. My car was the last one hit. We exchange insurance info but I did not hear from the adjuster at all. I found out that the insurance co. of the responsable party declined coverage due to payment. So I started a suit in the District Court (since damage exeeded the 3000 limit of small claims court). But now, I find out that the responsible party is fighting her insurance co. They are not giving any info but what I gather is that she is claiming that she mailed the payment on time and it got delayed on the mail. She does not even have a court day yet for the case against the insurance co. Could a judge order her to pay for my damages and then she can recover them from the insurance co. if she wins the case? Or is my court date with her is to be delayed until her court date against the insurance co. My car really needs the repairs. In fact, the repairs are worth more than the car? Would the judge only grant me damages up to what my car is worth or could he make her pay for my damages in full? Thank you very much!!
