contingency fee

if an attorney says they charge 50% of the 'gross'judgement does that mean the costs incurred would come from my 50% or would they be split?

It means the lawyer will take his/her 50% from the TOTAL settlement and then deduct expenses from YOUR share. Might want to either renegotiate the deal (if you already signed a contract) or look around. A 50% contingency fee is not necessarily outrageous but it depends on the specific facts of a case. If a lawyer is risking (and I do mean risking) $15,000 or more on your case then that might be fair. In a contingency fee case, the risk of losing is on the lawyer and not the client. Most clients cannot afford to spend even $5,000.00 or more on a case. Remember that there is never ANY guarantee that you will win your case - so there is some risk in practicing law.
