Legal Question in Criminal Law in Arizona

Criminal Law

Inquiring on behalf of a friend currently incarcerated in CA at CCWF-Chowchilla. She gets out in 10/08. Has a hold on her to be extradited to AZ upon release. Wants to get credit for time served in CA and not get extradited. What needs to be done for this to happen?

Hiring a private attorney to investigate the matter would be best option. If she does not have the means to do so, there are some non-profit organizations which might be helpful, at least in terms of giving her advice as to whether anything can be done, or directing her further to some resources. One such organization is called Prison Law Office, I think.

A miracle.

States do not give credit for time served on unrelated crimes in other states, generally.

Whether they extradite her is up to AZ at the time of CA release. The 'hold' indicates they intend to. She can fight the extradition if she thinks she has proper factual and legal grounds, and is willing to spend the money to do so, or can find some 'prisoner rights' organization willing to do it for her. However, "Just because I don't wanna go" is not good grounds. If that were the case, nobody would ever be extradited.

A stay or removal is generally the procedure, but I must find a basis to do so, which requires more facts. Call when she decides to hire a private attorney.
