Legal Question in Family Law in Arizona

an ex girlfriend called me out of the blue and told me she was pregnant. according to the time line given, it is reasonable to think that i am the father and until proven otherwise i will take responsibility. my question is that she want's the baby to retain her maiden name and not allow the boy to have my last name. i have not found anything saying that she can legally put her maiden name as the boys last name on the birth certificate. i guess that's not a question, but hopefully you lawyer guys can decipher what i'm trying to ask.

You have the righ to seek custody and paenting time. You have the right to seek that your name be added to the birth certificate, and that the child have your last name (or at least hyphenated). But you cannot force these things (if she will not agree) except by initiating legal action.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
