Legal Question in Family Law in Arizona

How long do I have to file a response to a petition to modify parenting time and child support? Also how does the court "assign income" to an ex spouse who has voluntarily surrendered her employment?

Generally, a Response must be filed within 20 days. There are exceptions depending on exactly what the other party filed - I recommend that you speak with an attorney who can review the documents and let you know what/when to file.

The court has the authority to attribute income to an unemployed or underemployed party, but it really depends on the circumstances.

We offer a free initial consultation, so please call our office to schedule a time to meet with one of our attorneys.

You have 20 days. I would need to know more to give you some strategies and thoughts regarding attributing income.

We can certainly help you consider and then pursue your options for responding and dealing with child support issues.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Alicia or my paralegal Jennifer to schedule your free 1/2 hour consultation.
