moving out of state without fathers consent

i want to move out of state with my daughter. her fathers name isn't on the birth certificate and she has my last name. he has not taken a paternity test to prove she is his daughter, although i know he is. he gave me 350.00 the first week after she was born, but has never helped out since then. she is now 2 months old. is it legal to move out of state with my daughter without letting him know?

Well, I'm not in Arizona but I can't see that the law would be much different on this question. I assume you were not married to the father, either. In that case, the relationship between father and child is only hypothetical at this point. In order to be entitled to visitation (or be required to pay support) there would have to be some kind of court determination that he is the father. At this point, I imagine that you can probably do what you want. Except, if you decide to place the child for adoption or if you do marry and your husband wants to adopt, you would be required to notify the person who you believe to be the father.
