Legal Question in Immigration Law in Arizona
My 29yr old fiancee and I have been together for 6 years and we have 2yr old twins together. She came to the US from England with her family on an E2 visa when she was 10yrs old. Her parents divorced when she was 17 and she has never applied for a new visa since. She has a soc security# with the status "not valid for employment" & valid drivers license and has been working "illegally" in the US paying taxes ect since she was 18. We're getting married and I was wondering if there's anything we could do to get her status legal again without her being deported or barred from the US for 10 or more years (since she's been working illegally). Also, she and her sister travelled to England in 1997 and had trouble returning. She was issued a 1 month E2 visa under her mother with an I-94 card.
1 Answer from Attorneys
Yes, she might be able to "fix" her situation and obtain a green card, provided that you are a USA citizen, you are married, and she was inspected and admitted to the USA, etc.
