Legal Question in Immigration Law in Arizona

My name is Sandra. I am 26 years old. I am a US Citizen. I am trying to bring my Mother and Sister (15 yrs old). They're born and live in Colombia. My mother came to the US with Tourist Visa and left the US by choice when I was 9 yrs old. She was never deported from here. She has no criminal history. I know it will be easier to bring her since she considered 1st priority being my Mother, it might take 1 year, however the problem is my sister (takes 10 yrs). If my mother comes first my sister has no place to stay, she is a minor, she will be byherself. Is there any other options or any other way so my sister is not left alone? any other way to avoid a long wait such as 10 years?

The previous answer is absolutely wrong. Your mother will NOT be able, unfortunately, to bring your 10-year old sister with her. Because you will petition for your Mom as an Immediate relative, and in this visa category no derivative relatives are allowed.

The option could be to file for your sister first, and wait for a few years to petition for your mother, so when your sister's visa is available (currently, it takes 9 years), they can immigrate together.

Your sister can't be included in your petition for your mom.

The fastest way to bring your 15-year old sister will be the petition through your mom, after she becomes a legal permanent resident in the US. However, you should act ASAP on your mom's petition because the waiting time will be different when your sister turns 21.

We suggest you to consult with an immigration attorney.
