Accident-other driver cited

Hello!

My vehicle was hit by someone that ran a red light. I was not in the car,and own it by title only,the insurance is held and paid by for by the person driving the car at the time of the accident. The other driver was cited at the scene. I have no idea what to do, what am I responsible for doing? The driver of my car has some whiplash and is seeing a chiropractor. He has also rented a car saying the other driver will pay for all this. He has not contacted his insurance at this point. Should I transfer the title now? He is purchasing the car from me and making payments and I am holding the title (of course) until it is paid off. thank you!

At this point, your property has been damaged. Either you or your buyer (driver) needs to have the vehicle inspected (full), with the estimate forwarded to the other party's (driver at fault) insurance company. Typically, the other driver's insurance company will have their own damage evaluators. Also check your buyer's insurance for property damage, which may be able to make the repairs then submit the bill to the opposing party's insurance carrier. Your buyer, after he/she is done treating, will submit their medical expenses and other damages to the insurance carrier for compensation. If you transfer title, it does not sound like you have any other written security interest in the vehicle, therefore risk loss of the property. It's a good idea to have a written agreement with your buyer that he/she is to maintain certain insurance coverages on the vehicle and that you be indemnified for any losses should no insurance be maintained.
