It is best for you to retain an Arizona attorney to prepare such an agreement. And, I can not emphasize it enough, that you must have a full and complete agreement in order to protect your interests, as well as those of your son. Whether or not the agreement is recorded, would be determined by the provisions of the agreement and how the sale is ultimately to be consummated. It may not be in your best interests to record the agreement for a number of reasons. Be sure to consult an experienced attorney. I would be happy to discuss what you are trying to do without charge for a short consultation.
