Legal Question in Wills and Trusts in Arizona
Mortgage payments
A widowed mother left her home to her three adult children. The only debts that she had were to the mortgage company (under $5000.00) and the state Long Term Care program (unknown). Both debts will be listed in the probate. Are the children required to make payments to the mortgage company until the probate is settled?

Re: Mortgage payments
If mortgage payments are not made, the lender will usually begin foreclosure proceedings, which add a lost of costs to reinstate and save the house. Better to contact them, negotiate something on the payments, make some payments etc. if you are not going to sell the house right away.
See an estate attorney who can also deal with ALTCS on its lien.
