Legal Question in Business Law in Arkansas
Cancelling A Contract
I signed a contract for a time share scenario while on vacation in Hawaii. The contract stated that it was to be governed by the rules of Arkansas.
The contract stated that said contract could be cancelled for any reason within seven days. I attempted to cancel the contract nine days later. I received a response stating that I had missed the deadline for cancelling the contract and was responsible for fulfilling the terms of said contract.
I attempted to cancel said contract due to a misleading presentation. The materials presented to me (terms and conditions) in writing and verbally were different than the materials I received after signing the above mentioned contract.
My questions are 1.) Can I cancel a contract for any reason within thirty days, even if the contract states only seven days? (2.) If I cannot cancel the contract for any reason within thirty days, how (what legal pretext) should I dispute the contract?

Re: Cancelling A Contract
You could possibly argue fraud, misrepresentation, and/or breach of contract for starters. Since I do not know all of the facts of the case, I cannot comment further.
