Legal Question in Family Law in Arkansas

Here is my situation, I have a 5 year old daughter. Dad and I have been together for about 11 years. We are not legally married but have filed taxes married I believe since having Lily. He has traveled on and off for work through the years. He has gone back to Colorado where we are from supposedly for work but seems to be having an affair with a married woman. Her husband keeps calling me regarding it. Anyway, I am still on the fence about what to do but definitely want to ensure I have my ducks in a row in case this goes down the bad path. I don�t want to break up our family, but it looks as if I might not have a choice. I want to know if there is any way he could file something in Colorado that would cause legal problems for me. Right now, I think he should have to come to Arkansas to visit her, and he should have to pay child support. My bottom line question is, do I need to do something to ensure this all happens in Arkansas or how does this work? Due to his history and current activities of smoking pot, etc., I am not comfortable with him having her alone with him in another state.

All of the bills and the house are in my name, and I pay them all. The only thing that is in both of our names is his truck which he usually gives me the money for but not the insurance. If you need any further information, please feel free to call or e-mail me.

Since the 2 of you were never married, has he done anything to establish himself as the legal father, if not then he has no legal rights with regards to the child. You could file suit to establish paternity and petition for child support. You did not mention how long the child has been with him in Colorado. This may be an important factor.
