Mareva orders and equity policy
Mareva orders are made ex parte, and have the ability to crush a defendants business - even though the issue has not yet been tried in court! Does this line up with any general princples of modern equity? What is this then supposed to say about the nature of modern equity? i thought the branch of law was supposed to be 'fairness first'!
