Legal Question in Bankruptcy in California

Bankruptcy / medical bil l/ car accident

Should I file for Bankruptcy now (and not pay hospital) or if they agree pay them $16k and wait to see if or until UC Davis sues me for the rest of $200k?

Misc info on incident:

- Accident (hit and run) about 1.5 years ago

- Didn't have medical insurance

- Was taken to UC Davis by paramedics

- Had operation on my elbow (metal plate was inserted)

- Hospital bill is about $200k+

- Car insurance medical/hit&run limit about 20k

- I have a lawyer, he is trying to negotiate the hospital from suing me; there is possibility of them going after me due to settlement request sent by lawyer is for about 16k from car insurance settlement.

- I am currently unemployed

- I don't have any assets

You may look into filing bankruptcy where you may be able to seek a discharge all debt prior to filing bankruptcy. You can still list the hospital as a creditor even though you have not yet received a bill.
