Legal Question in Disability Law in California
ada
I recently went to a group interview with the department store kohls and unfortunatly recieved a confusing letter from them stating why i wasn't hired even though stated in the letter and recongnized by the manager that i do have various experiences they still didn't hire me and am wondering if it can be because i am disabled and they just had to word it nicely in my letter. i am more then willing to fax over a copy to you so that i can get your perspective on it as well this is the second time this has happened to me with this company i get the ''group'' interview then after get the letter. thank you for your help on this matter . i thought usually employers want /and or need people with various experience ,if any experience to be able to not just work, but make it easier for them and they're company as well i have experience not just in retail, but office, customer service as well so can't seem to understand why they wouldn't put me in one of those areas being i do have various experince in them . or has that changed..lol???

If you have a condition recognized as a disability under the law, you can speculate it was discrimination, but to succeed in legal action will require actual evidence. That is usually hard to come by, generally a witness admitting to improper comments about you, or similar testimony.
You could hire ounsel to write them a 'demand' letter in the hope that they would reassess your qualifications and put you back in the applicant pool, but there would be no guarantees of success in that effort. Feel free to contact me if you want to do so, or if you think you can get evidence supporting legal action.
