Special education

My son qualifies for RSP under other health impairment. He has epilepsy. On January 25th it was determined during an IEP meeting that the school was out of compliance. We agreed it would be okay if the school did not skip any further sessions. However in February they began skipping sessions again. On March 7th I wrote a letter and informed the school that I would file a complaint with the state if they did not resolve this immediately. On March 9th they classified my children as truants. They never responded to my letter. This was bogus they were not truants. My youngest child had missed a total of three days that were cleared at the district office. My special ed child miss 7 and 6 of them he was in nuerology. I even have an award that he received signed by the principal on a date they list him absent.

Next I file a complaint with the office of civil rights. They find everything I state is true. Now the school is to rewrite the IEP and provide compensatory time. The problem is I don't want to keep my kids in a school that retaliates.

You are already aware of at least some of your child's rights and procedures for remedies. However, it is not guaranteed you have the absolute right to a school change. There is a process of formal request and justification you will need to pursue under the Ed code. Feel free to contact me if you want help with the paperwork, putting your arguments in the most favorable manner.
