Legal Question in Administrative Law in California

Administrator appointed by court?

What procedure does one take in order to become administrator appointed by the court, in such case where an elderly individual is unable to make a decision on her own? The elderly does not have alzheimers, but is still having trouble coming to an agreement. We are in process of moving her into a rest home, she cannot take care of herself alone. We need to move her into the home, and put the home she is in up for sale.

Re: Administrator appointed by court?

You are describing a Conservatorship, which is obtained by filing a Petition in the local probate court, and proving that you or someone must be put in charge of her. It is a detail oriented process that you should do through counsel. Feel free to contact me for help if this is in Southern California. If elsewhere, check your local Lawyer Referral Service for someone.

Mr. Nelson is right. If you or she cannot afford a lawyer, ask the county public defender if that office handles conservatorship matters.
