Legal Question in Administrative Law in California

Disagreement with landlord on security deposit refund

What is my Son's recourse with the

landlord who has refused to return any

security deposit due to alleged

damage to rented residential property?

I have had to get a copy of the

landlords allegations as I have not

received written notification of specific

damages within (21) days. Landlord

refuses to discuss matter.

The law on this subject is codified at Civil Code section 1950.5, and it is a bit long to summarize here, but a non-lawyer should be able to locate, read and understand its provision.

I believe it is in 1950.5(l) (the letter L) that you find the provision for triple damages for bad-faith refusal to make refunds.

This may be a suitable matter for a small claims court action.
