Legal Question in Administrative Law in California

Overtime

My job did not pay me all my

overtime before they let me go, I

was wondering if there is a way to

get that money?

For the two years that I worked

there I would clock in thirty minutes

early but they state that because I

did not fill out a form to get approval,

they do not have to pay. Now this is

not always the case, there were

many times when I did not fill out

the form and they paid my overtime.

Re: Overtime

File a claim with the Labor Commissioner. If the amount of unpaid OT is enough to justify hiring counsel to help you in the hearings, feel free to contact me, if the case is in SoCal.

Re: Overtime

You can sue, and many attorneys would take your case because you can collect attorney fees on top of your overtime, or you could contact the State of California Labor Commissioner, Division of Labor Standards Enforcement and they will file a claim. Hope you kept accurate time records and you retained copies of them.
