Legal Question in Bankruptcy in California
chapter 7 bankruptcy
Hello, i had a paralegal prepare the paper work for chapter 7 for me in 11/2008 ,but i never went down to the courthouse and filed my chapter 7 paper work,so in other words i had it prepared but never filed. i recently viewed my credit report and under the public records section it is showing some kind of information that i filed chapter 7 bankruptcy,is that the info my paralegal may have submitted.Do i still have time to get the chapter 7 paper work filed and proceed with my chapter 7 bankruptcy.or is it to late. thank you for your help.

I'll give you the same offer as Attorney Cohen. We have access to the court's records, and if you want to email me (or Attorney Cohen) your full name & address, we can see if a case was filed. Its very unlikely that the paralegal filed it for you - the paralegal would have had to pay $299 court filing feee - but its not impossible. Give one of us your information, and we'll look it up and tell you what you can do.

Feel free to e-mail me your full name and address and I'll check the court docket to see what appears, and suggest to you appropriate steps. Usually paralegals (without an attorney) are not permitted to file the paperwork. It's up to the debtor to do so.
