Legal Question in Bankruptcy in California

Collection after bankruptcy

I filled for bankruptcy 5 years ago, missed listing 3 medical bills collections in the debt list. It is still showing in my credit reports. the credit report agencies refuse to remove it. what can I do? the total for three collection is about $2500.

If your case was a Chapter 7 with no assets available to pay creditors, the In re Beezley case allows a discharge of debts that were not listed. The failure of a Chapter 7 debtor to list a creditor�even if intentional�is not a basis for revoking the resulting discharge of debts unless the creditor shows the debtor had assets, the Ninth U.S. Circuit Court of Appeals ruled yesterday.

In a no-asset bankruptcy, in which normally no deadline is set for creditor�s claims, proper notice to the creditor would not change the outcome.

You should send a letter to the creditors and the credit reporting agencies referencing this case.
