Legal Question in Business Law in California

Awarded Judgement

I sued someone and won the civil case

in California. The defendant now lives in

Maine. Do I need to do anything in

Maine to enforce the judgement or can

I just submit the order to his employer

in Maine to garnish his wages?

Re: Awarded Judgement

You need to have the order domesticated in Maine before you can enforce it against assets or income in that state. Try re-posting the question under Maine law to get more information from lawyers in that state.

If the defendant still has assets or income sources in California, you can execute against those sources regardless of where he now lives.

Re: Awarded Judgement

You will need to file the CA judgement in Maine as a "sister-state" judgement.

You can always try to just submit the claim to the current employer, but there is no requirement for them to comply without the sister-state Judgement.

Additionally, if the defendant has any assets still in CA, even a bank account, you can attach that immediately.

Please let me know if you need assistance in the process. I can be reached at the email provided by LawGuru or through our firm's website PasadenaEstatePlanning.com.

Re: Awarded Judgement

You have to have that state recognize your judgment by filing an appropriate action in that state, and it varies from state to state. You can contact that state court clerk's office and see if they will answer your question on how. You'll probably have to hire an attorney in that state.
