Legal Question in Business Law in California

car loan

10 years ago i took out a car loan in

which i never paid. the car was

wrecked and i never paid the balance.

Now 10 years later they put a hold

on my bank account and say i owe

$30,000 i realize i should pay them,

but i never recieved anything from

anyone (mail, phone call certified

mail) nothing at all. $30,00 is more

than twice as much of what i owe

them. Can you please tell me my

options?

You have few options, since you're talking about a 10 year old debt and judgment. It's long past time you could challenge the judgment, if it was obtained timely and properly - way back then. Have the paperwork and file reviewed by counsel to see if there are any grounds to challenge the judgment for being improperly or untimely obtained. If not, then you're going to have to negotiate a 'deal' with the judgment creditor, or file bankruptcy if appropriate. Feel free to contact me if serious about doing so.

It's also possible that your account is at the same bank which made the loan, and they have decided to offset the loan against your deposits without taking you to court or getting a judgment. If that's perhaps what's happening, your rights may be greater and you should mention this possibility of an offset to your lawyer if applicable.

Apparently a court judgment was obtained without notice to you. If the judgment was obtained more than 4 years after your last payment was missed, and if you act IMMEDIATELY, there is an excellent chance you can beat this. Please contact me. The last person who came to me with this kind of problem failed to act in time,and now he is stuck with paying them forever. If you have a court case number this would be very helpful or if it is in the OC court system I would be glad to look it up for you.
