Legal Question in Business Law in California
clients from business
The client based business I work at was
sold and the new owner is running the
business into the ground. She bought
both the building and the rights to use
the clientelle from the previous owner.
A group of us are going to start our
own similar business within a couple
miles of this business. During the
course of business we have developed
relationships with the clients and they
have voluntarily given us contact
information for use. Many have been
aware of the sale and many have asked
to be contacted if we ever decide to
move to a new location. My question is,
can we legally contact these clients via
mail and/or telephone letting them
know of the new location or can our
current owner sue us? There are no
contracts signed between ourselves and
the owner.

Re: clients from business
This presents a potential minefield of problems for you that is likely to end in a lawsuit. Therefore, I recommend that you pay for a consultation with an attorney to discuss your options and how to avoid some problems with the former employer.

There are a few ways you can do as you seek, and many that will get you sued. You should consult with experienced counsel before taking any action to leave or do marketing. Feel free to contact me if interested in doing this right.
