Legal Question in Business Law in California
Contract to sell
I have manufactured a product for a customer. He want to buy it on credit basis but his credit is not good. I have asked him to take on COD basis. He refuses COD terms and also threaten me with a law suit if I sell the product to someone else. What process should I follow to sell this merchandise to some other party without legal trouble. I want to sell it as quickly as I could as my cash flow is strained.

Re: Contract to sell
What does your contract with your customer say? There is no way to answer your question without this information.
Re: Contract to sell
A review of the contract would be necessary before an attorney could give you the necessary advice. The other party may already be in breech of the contract, which would give you legal options, however a review of the contract is vital before making that determination.
Feel free to contact me if you would like to discuss this further.

Re: Contract to sell
You're not going to get an informed opinion without a full review and discussion of the facts and documents involved. You may be able to sell the product to others, depending on ownership of intellectual property rights in it. Feel free to contact me if you want to get help in this.
