Legal Question in Business Law in California
I am in desperate need of advice. I recently entered into a business partnership with two other people. Our agreement was that since, they owned their joint business together and they were extremely excited about the business that I was bringing to the table, that they were going to provide the financial part of the new business and I was to provide the setting up, the structuring, the training and the resources that would make the business. we agreed in several meetings that the profit would be divided and my percentage would be 22%. Because I would have to be away from my home and family all week for several weeks they agreed to take care of my lodging while there. They also promised that my family would not be left with need. It has been approx. 4 months and we have come to the point where the profit is substantially beginning to arrive in large amounts of money. But I had to come home to move my family because we were forced to move due to inability to pay the rent.(they did not provide me with the coverage for my family as promised) at the same time my transmission went out in my car and I have sent to mechanic for repair. When I called them to let them know my monetary needs so I could have a vehicle to move my things out of my house, they have stopped taking my calls they dont return my messages. This has all taken place in two weeks. I have been put out of my home and my family and I are literrally on the street without even a vehicle. They are still operating the business using all of my materials, my scripts, my resources and basically everything that I have set up. They refuse to even speak to me or offer me any money. During the last 4 months they have said several times that the contracts were being done however they were never presented so our agreement was all verbal but I can prove that everything was done by me with my resources and materials. I am in Ontario California and the business was in Roseville California just outside of Sacramento. My family and I have been left penniless and homeless after I gave 500 % into the building of this business.

Well, you have stated what appears to be grounds for lawsuit for breach of contract and/or fraud, assuming you can effectively prove your allegations, and thus your claims, with credible and admissible evidence. What that means though is, unless your attorney can quickly resolve the problem, settle your claims with them, and get you paid something, then you are in for a year of so of litigation to get the case to trial, all without income or payment from them.
