Legal Question in Business Law in California

Judgement (Business LLC)

Can a writ of execution filed by the prosecuting party be effective against personal property? Because in my case. I shut down the LLC I got sued for and my concern is if my personal property such as my house, car, ring, etc... can be taken to pay that debt. This was a LLC company. Thanks!

Re: Judgement (Business LLC)

If your personal name is on the judgment order, all your personal assets can be taken. "I got sued" suggests to me it is. You'd be asking your attorney these questions if you'd used one as you should have in the case; maybe there wouldn't be a judgment against you if you had. Consult an attorney now to see what can be done to negotiate a 'deal' or maybe file bankruptcy if appropriate.

"Can" a California writ be executed against personal property? Absolutely!

Before it is too late, you need a _competent_ attorney to advise you.

Good luck.
