Legal Question in Business Law in California
Is it legal for my employer to clock me off without me knowing? I work at a gym and recently was told I had to clean my area after class. The problem is they clock me off when the class is done and not when I'm done cleaning. Also, sometimes one boss will ask me to stay and the other one just clocks me off without me knowing, thinking I'm just hanging around. I discovered this on my last paycheck and it caused a huge disagreement. Aren't I supposed to clock myself off? Can she legally clock me off even though I clock myself on? She doesn't do this to everyone. Just when she thinks you are not leaving when you are supposed to.

The question is not whether your employer is clocking you out but whether you are being paid for hours worked. The law does not address who clocks out whom but whether you are being compensated for hours worked. Perhaps your employer is engaging in a course of action to deprive her employees of proper compensation. You may want to considers filing a complaint with the labor department.
