Legal Question in Business Law in California
Hello,
I am the owner of a hot dog cart business in San Diego, California. I have been in my current location for 8 months, establishing a very loyal clientele. Today I found out that another person is building a hot dog cart in the exact place where I have been setting up. I went to talk to my landlord and he told me that he had leased out the parking lot to someone else. I went to talk to this third party and they informed me that he had signed a one year lease with this new hot dog cart owner. I am wondering if I have any rights in this situation. I was not informed of anything that was going on, and only discovered what had occurred because I happened to walk by the spot. I have established the location for late night hot dog buying, and now someone else is going to reap the benefits of my hard work. Is there anything I can do?

If you had a lease, you could enforce it. You merely 'trespassed' and used the property of someone else without drawing an objection.
