Legal Question in Business Law in California
Property Abandonment
What recourse is open to the owner
of a horse ranch incurring debt from
a client who will not pay the training/
board bill? May the ranch owner
legally sell the horse to settle the
account? The client has paid no
money in six (6) months, will be out
of the country for at least a year,
and refuses to accept any offers of
sale.

Is there a written contract between the owner of the ranch and the owner of the horse? If so, its terms will govern.

You may sue for breach of contract and attach the property to collect on the judgment. There may also be other options. Contact me directly.

Contact local counsel for specific advice and assistance in following the lien sale rules applicable to this, to avoid getting sued by the horse owner for doing it incorrectly.
