When people enter into a contract, by taking a deposit and agreeing to sell, they risk being sued if they refuse to refund the money, even if the other party is at fault and changes their mind. Now that you have been sued, you could potentially counter sue her for breach of agreement. You'll need to consult with your attorney to determine your rights and remedies, and the costs and risks of this litigation. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me.
