Legal Question in Business Law in California

stole car hit and run from my work

Someone stole a car and got in a hit and run from my work. now the person who owned the car and the person that got hit are sueing us. They think that the person who took the truck worked for us and this is not true. are we protected from being suied because he signed the paper stateing that we are not resposible for loss or damage to vehicle or articles left in vehiccle in case of fire, theft, accident or any other cause beyond your control. the truck was found the same day it was stolen and the person who took it is now in jail. we did do alot of work on his car after this happened free of charge. because my boss somehow feels like it was his fault that this stranger stole that car. can we be civilly sued by them?

Re: stole car hit and run from my work

If I understand you correctly, Person A parked the truck at your business after signing a waiver, but then Person B stole the truck and hit Person C with it. A and C are now suing you.

The waiver only applies to Person A. Person C did not agree to it and is not bound by the agreement. Even as to A, the waiver may only apply to certain types of claims. Without knowing what the waiver says, there is no way I can say whether it applies to the type of claim you describe.

"Can you be?" Of course. Anybody can sue anybody for anything. Winning is a different question. Turn this over to your insurance company and cooperate with them in defense. If you had no insurance, then hire an attorney to take care of you in this. He will use whatever facts and law are in your favor to defend you. If serious about doing so, feel free to contact me.
