Tutor Brokerage

hello, what are the legal concerns for a tutor brokerage. Tutor brokerages screen tutors and connect them with parents and students taking a commission off of hourly rate. Tutoring done at student's home with person over 21 at home, or public location such as library.

Sounds like it might fall under the definition of an employment agency or temporary agency, and I would check the provisions of the Business and Professions Code applicable to such agencies. You can find the B&P Code at a law library (there is at least one in every county) and the librarian can show you the code index and help you find the volume and sections to review.

Substantial liabilities exist. Any misconduct or crimes by tutors would subject the company to lawsuits. Such companies should have excellent screening and supervision, insurance, waivers to be signed, consulting agreements if appropriate, payroll and employee benefits compliance, etc. If serious about doing this rights, feel free to contact me for help in doing so.
