Legal Question in Business Law in California

I know someone who was working for 10 years but claiming their wife worked instead so they could collect disability. Is this disabiity fraud considered tax fraud?

If I understand what you mean by "tax fraud," the answer is "not automatically." To determine whether someone has committed tax fraud would require comparing their tax returns with reality.

I agree with Mr. Whipple. What you describe is fraud, but it would only be tax fraud if your acquaintance and/or his wife knowingly misrepresented their finances on their tax returns.

Fraud? Yes, by using false name, and by collecting disability while working under false name. Not necessarily TAX fraud, but benefits fraud that the DA and EDD would be interested in learning.
