if in 1998 i was convicted of a 2nd dui license is suspended currently due to this charge,and in March 28,2008 i was notified by the chief of police of the arresting agency that my 2nd dui in 1998 was a clerical error due to the courts is their a civil suit

No. But it may be grounds for motion[s] to the court and DMV to set aside the conviction and suspension. I don't know how a 'clerical error' resulted in a conviction where you either entered a plea bargain, or were found guilty at trial. Consult with a local criminal attorney to discuss the actual facts and see what can be done.
