Legal Question in Civil Rights Law in California
a 53 foot Trailer came to our premises, and was left here for more than 80 days, we never put a lien holder on it.Now the owner of the trailer hire a Tow company to Pick up the trailer but they don't want to pay they are going to call sheriff
1 Answer from Attorneys
If you are entitled to a lien, then you should properly and timely assert it. "Our premises" does not explain who 'you' are. If you are a business in storage or repair in some form, and can show how you are entitled to the money you claim, then you may have lien rights. If you are simply a friendly neighbor, no lien rights. If it is worth enough to justify paying attorney fees to pursue this, consult with a local attorney to help you. Even if you can't assert and enforce a lien, you might have rights to file suit in small claims or Superior court after they pick up the vehicle.
